Before you cancel

Pre-requisites for an Employment Visa Cancellation.

A cancellation is where unresolved obligations surface. These six are settled before anything is filed — which protects the company as much as the employee.

Prerequisite 01

Ministry of Human Resources & Emiratisation

Labour is cancelled before immigration, always. The MOHRE file must be in a state that allows the cancellation to be filed, and the labour receipt is what unlocks the immigration step.

What must be in place
  • Trade licence and establishment card valid at the time of filing
  • No outstanding MOHRE fines against the establishment
  • E-signature card valid for the sponsor or owner
  • Labour cancellation filed first — the receipt is attached to the immigration submission
  • WPS settled for the employee’s final month of service
  • Company seal and sponsor signature on the typed cancellation form
Where files stall: Filing immigration before labour is the single most common cause of a rejected cancellation. The order is not optional, and it cannot be corrected by resubmitting out of sequence.
Prerequisite 02

Resignation or termination

The reason for the exit determines the paperwork, the notice obligations, and in some cases whether a labour ban applies. It needs to be documented before anything is filed.

  • Resignation letter on file, dated, where the employee is resigning
  • Termination letter on file, where the employer is ending the contract
  • Contract type — limited or unlimited, which changes the obligations on each side

  • Ban implications checked, where the exit is contested or mid-contract
Where files stall: An undocumented exit is where cancellations turn into labour cases. We confirm the paperwork exists before we open the file, for the company’s protection as much as the employee’s.
Prerequisite 03

Notice period served

Notice is a contractual obligation on both sides. Cancelling before it is properly served or bought out leaves an exposure that surfaces after the employee has gone.

What to verify
  • Notice period as stated in the employment contract, not assumed
  • Notice served in full, or formally waived in writing by both parties
  • Payment in lieu documented where notice is bought out
  • Last working day agreed and recorded
  • Handover completed — company property, access and accounts returned
  • Limited contract early exit — compensation implications checked
Where files stall: Where notice is waived or paid in lieu, get it in writing before cancellation. A verbal agreement is worth nothing once the employee has left the country.
Prerequisite 04

End of service benefits

Final settlement comes before signature. The employee should not sign the cancellation paperwork until their dues are received — and the company should not file until settlement is documented.

  • Pending salary up to the last working day, paid in full
  • Gratuity calculated on basic salary, not total package
  • Under 5 years: 21 days’ basic pay for each year of service
  • Over 5 years: 30 days’ basic pay for each additional year
  • Accrued leave encashed as per UAE labour law
  • Repatriation ticket, where the contract or the law provides for it
Where files stall: The employee should not sign the cancellation paper before receiving their dues. Once signed, the leverage is gone — and unresolved settlements become MOHRE complaints.
Prerequisite 05

Documents & NOC

A cancellation file is small but exact. A missing original or an unsigned form sends the whole submission back.

  • Original passport of the employee, for the immigration submission
  • Original employment visa, collected from the employee
  • Emirates ID returned by the employee
  • No Objection Certificate, where the circumstances require one
  • Signed cancellation form, after dues are received
  • Labour cancellation receipt, attached to the immigration form
Where files stall: Passport and original visa must be physically available. Cancellations stall most often because the employee has already left with documents the company needed.

Grace periods & what follows

Cancellation starts a clock for the employee. Knowing the windows protects both sides from fines that nobody budgeted for.

After cancellation
  • Visa grace period — 30 days from the date of cancellation or expiry
  • Labour card grace period — 60 days from the date of expiry
  • Emirates ID grace period — 30 days from the date of expiry
  • Dependants’ visas must be cancelled or transferred alongside the sponsor’s
  • Outside country route applies where the employee has been abroad more than 6 months
  • Status transfer — a new sponsor can take over within the grace period
Where files stall: If the employee sponsors family, their dependants’ visas fall with theirs. We flag this at the start so nobody discovers it after the grace period has run.

Inside Country Cancellation

Cancelling an employment visa inside Dubai mainland involves several steps. This process is generally initiated when an employee is leaving the company, resigning, or if the employment relationship is terminated for any reason. Here’s a detailed overview of the steps.

Resignation or Termination

Ensure that the resignation or termination is officially communicated and documented. If resigning, provide notice as required by your employment contract. If terminated by the employer, ensure that all legal and contractual obligations are met.

Final Settlement

Settlement of Dues: complete all financial settlements, including any pending salary, end-of-service benefits, or other compensations as per UAE labor law.

Prepare Documents

No Objection Certificate (NOC): sometimes required for the cancellation process. Employment Visa Original: collect the employee’s original employment visa. Passport: ensure the employee’s passport is valid.

Initiate Visa Cancellation

Labor Card / Work Permit: the company must cancel the labor card, also known as a work permit, through the Ministry of Human Resources and Emiratisation (MOHRE). GDRFA Application: submit all required documents, including the cancellation application form, passport copies, and any supporting documents, to the GDRFA. Processing Time: the processing time for visa cancellation usually takes a few days.

Completion

Receive Cancellation Confirmation: once the visa is canceled, you will receive confirmation from the GDRFA. Documentation: ensure all related documentation, including the canceled visa and any other relevant papers, are kept for records.

Outside Country Cancellation

Cancelling an employment visa for a Dubai mainland company when the employee has been outside the UAE for more than 6 months involves a slightly different process. Here’s a step-by-step guide to handle this situation.

Employee Departure: ensure that the employee has left the UAE and is currently residing outside the country for more than 6 months. Communication: the company should communicate with the employee to confirm their status and discuss the visa cancellation process.

Prepare Documentation

Employment Visa: collect the employee’s original employment visa if available. Passport Copies: ensure you have copies of the employee’s passport. No Objection Certificate (NOC): this might be needed, depending on the situation.

Initiate Visa Cancellation

GDRFA Application: submit the visa cancellation application to the General Directorate of Residency and Foreigners Affairs (GDRFA). Labour Card / Work Permit: the company needs to cancel the labor card, or work permit, through the Ministry of Human Resources and Emiratisation (MOHRE). This is generally done online via the MOHRE portal or Tasheel.

What order must a cancellation be filed in?

Labour first, then immigration. The labour card or work permit is cancelled through MOHRE, and the labour cancellation receipt is attached when the immigration cancellation is submitted to GDRFA. Filing out of sequence is the most common reason a cancellation is rejected.

How long does an employment visa cancellation take?

Processing at GDRFA usually takes a few days once the labour cancellation is complete and the documents are in order.

What if the employee has already left the UAE?

If they have been outside the country for more than 6 months, the outside country route applies. A travel report at 272.50 AED is required to evidence the absence, and the visa cancellation fee is higher at 222.50 AED through GDRFA.

Should the employee sign before receiving their dues?

No. The final settlement, including any pending salary and end-of-service benefits, should be complete before the employee signs the cancellation paperwork.

Is a No Objection Certificate required?

Sometimes, depending on the circumstances of the departure. We confirm whether one is needed for your specific case before the file is submitted.
