When an employee’s contract is terminated, either by resignation or dismissal, their employment visa may need to be cancelled.

Before you cancel

Pre-requisites for an Employment Visa Cancellation in Sharjah.

A cancellation is where unresolved obligations surface. These six are settled before anything is filed — which protects the company as much as the employee.

Prerequisite 01

Ministry of Human Resources & Emiratisation

Labour is cancelled before immigration, always. The MOHRE file must be in a state that allows the cancellation, and the labour step unlocks the immigration one.

What must be in place
  • Valid trade licence and commercial licence copy
  • Establishment card copy current
  • Company MOL number active, with no suspension
  • Sponsor e-signature card and Emirates ID available in original
  • Labour card cancellation filed first, before the visa cancellation
  • No outstanding MOHRE fines against the establishment
  • WPS settled for the employee’s final month of service
Where files stall: Filing the visa cancellation before the labour card cancellation is the most common cause of a rejected file. The order is not optional.
Prerequisite 02

Resignation or termination

The reason for the exit determines the paperwork and, in some cases, whether a ban applies. It should be documented before anything is filed.

  • Termination of employment — by resignation or dismissal
  • Completion of contract term where the visa is not being renewed
  • Violation of visa conditions, such as working for another employer
  • Relocation or departure from the UAE
  • Resignation or termination letter on file, dated and signed
  • Reason recorded, as it affects entitlements and ban position
Where files stall: An undocumented exit is where cancellations turn into labour cases. We confirm the paperwork exists before opening the file, for the company’s protection as much as the employee’s.
Prerequisite 03

Notice period served

Notice is a contractual obligation on both sides. Cancelling before it is served or bought out leaves an exposure that surfaces after the employee has gone.

What to verify
  • Notice period as stated in the employment contract, not assumed
  • Notice served in full, or formally waived in writing by both parties
  • Payment in lieu documented where notice is bought out
  • Last working day agreed and recorded
  • Handover completed — company property, access and accounts returned
  • Limited contract early exit — compensation implications checked
Where files stall: Where notice is waived or paid in lieu, get it in writing before cancellation. A verbal agreement is worth nothing once the employee has left the country.
Prerequisite 04

End of service benefits

Final settlement comes before signature. The employee should not sign the cancellation paperwork until their dues are received.

  • Pending salary up to the last working day, paid in full
  • Gratuity calculated on basic salary, not total package
  • Under 5 years: 21 days’ basic pay for each year of service
  • Over 5 years: 30 days’ basic pay for each additional year
  • Accrued leave encashed as per UAE labour law
  • Repatriation ticket, where the contract or the law provides for it
Where files stall: The employee should not sign the cancellation paper before receiving their dues. Once signed, the leverage is gone — and unresolved settlements become MOHRE complaints.
Prerequisite 05

Documents in original

A cancellation file is small but exact. Files stall most often because the employee has already travelled with the documents.

Where files stall: Collect the labour card and visa copies before anyone books a flight. Chasing them from abroad turns a two-day file into a two-week one.
Prerequisite 06

Route & grace periods

Whether the employee is inside or outside the UAE changes the route, the documents and the cost. Cancellation also starts a clock for the employee.

  • Inside country: labour card cancellation then visa cancellation, 281.14 AED
  • Outside country: travel report, visa cancellation and labour card, 653.64 AED
  • Travel report required to evidence departure on the outside route
  • Visa grace period — 30 days from the date of cancellation or expiry
  • Labour card grace period — 60 days from the date of expiry
  • Dependants’ visas must be cancelled or transferred alongside
Where files stall: If the employee sponsors family, their dependants’ visas fall with theirs. We flag this at the start so nobody discovers it after the grace period has run.

Labour card cancellation first, then visa cancellation. The Electronic Work Permit Cancellation is filed at MOHRE, and the visa cancellation follows through the E-channel.
